2. Scope of application
These terms apply to all contracts between VIKTORIA.training and consumers for training services and related offers booked via the website https://viktoria.training or booked directly (e.g. by email).
3. Scope of services
VIKTORIA.training offers in particular the following services:
- Open Classes (individually bookable sessions)
- Series courses with a fixed start and end date
- Personal Training (1:1)
- Training in the studio, outdoors or in an online format (depending on the offer)
- Credit/session packages for booking sessions (depending on the offer)
The exact scope of services follows from the respective offer page, booking confirmation or individual agreement.
4. Conclusion of contract and booking
The presentation of services on the website is not a legally binding offer, but an invitation to book. A contract is formed once the booking is confirmed and – where provided – payment has been completed successfully.
By booking, these terms are accepted.
5. Prices and payment
The prices published at the time of booking apply, in euros.
Payment is generally made via the payment service provider used (currently Stripe) or by individual agreement (e.g. payment link/invoice for personal training).
Unless otherwise stated, the booking is binding only after successful payment.
6. Credits/balance
Credit or session packages entitle you to book the sessions marked in each case, subject to the stated conditions.
Unless expressly regulated otherwise:
- credits are personal and non-transferable,
- unused credit is not paid out in cash,
- the duration stated on the offer page applies.
7. Cancellation, rescheduling and no-shows
7.1 Series courses
A free cancellation is possible until no later than 14 days before the course starts possible. In the event of a later cancellation or a no-show there is generally no refund. Missed sessions within a series are generally not refunded.
7.2 Open Classes / individual sessions
A free cancellation or reschedule is possible until 24 hours before the session starts possible. In the event of a later cancellation or a no-show the session is forfeited; there is no refund or return of credits.
7.3 Personal Training (1:1)
Cancellations or reschedules are until 24 hours before the session starts free of charge. In the event of a later cancellation or a no-show, a cancellation fee of 50 % of the agreed price becomes due.
8. Cancellation or changes by VIKTORIA.training
VIKTORIA.training may cancel or adjust sessions for good cause (e.g. illness, force majeure, severe weather, insufficient numbers). In that case – depending on the situation – an alternative date, an alternative format (e.g. online) or a pro-rata refund will be offered.
9. Requirements for participation and personal responsibility
Participation is at your own responsibility. Participants are obliged to report health limitations before training begins and, where needed, to obtain medical advice on whether participation is possible.
Instructions during training must be followed. In the event of serious breaches of safety instructions or unreasonable behaviour, exclusion from participation may follow; there is no entitlement to a refund in that case.
10. Liability
VIKTORIA.training is liable without limitation for intent and gross negligence and for damage arising from injury to life, body or health.
In the case of slight negligence VIKTORIA.training is liable only for breach of essential contractual duties (cardinal duties) and limited to the typical, foreseeable damage.
Otherwise liability is excluded – to the extent permitted by law.
11. Privacy
The privacy policy applies at https://viktoria.training/datenschutz.
12. Right of withdrawal
For contracts concerning leisure activities with a specific date or period there is no right of withdrawal pursuant to § 312g (2) no. 9 BGB.
Otherwise the statutory consumer rights apply.
13. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules of the country in which consumers have their habitual residence remain unaffected.
Should individual provisions of these terms be or become wholly or partly invalid, the validity of the remaining provisions remains unaffected.
The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. VIKTORIA.training is neither obliged nor willing to take part in dispute-resolution proceedings before a consumer arbitration board.
